Terms of Service

1. Acceptance of terms

By accessing or using https://deshna.in (the "Site") or by placing a wholesale order with Deshna Wholesale ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Site.

2. Business use only

The Site is a B2B wholesale platform. By placing an order you represent that you are a retailer, distributor, temple supplier, institutional buyer, or otherwise purchasing for resale / commercial use, and not as a personal consumer. Consumer-protection statutes (e.g., India Consumer Protection Act 2019) do not apply to wholesale transactions to the extent permitted by law.

3. Catalog, pricing, and quotations

Pricing displayed on the Site is indicative and subject to change without notice. Final pricing is communicated via written quotation (WhatsApp or email). Quotations are valid for 15 days unless stated otherwise. Brass is a commodity and subject to metal-price fluctuations; we reserve the right to revise pricing for orders placed after a quotation has expired.

4. Minimum order quantity (MOQ)

Standard MOQ is 10 pieces per order. Custom mold orders have an MOQ of 50 pieces per design. MOQ is waived for repeat buyers with an established order history at our discretion.

5. Custom mold orders

Custom molds are created on a one-time fee basis of ₹5,000 per design. Mold cost is non-refundable once the mold has been cut. The mold is stored securely at our facility for future reorders at no additional cost. The buyer does not automatically acquire ownership of the mold unless explicitly agreed in writing; we retain the right to use the mold for other buyers unless an exclusive-mold agreement is signed.

6. Production lead times

Standard in-stock designs: dispatched within 5–7 working days. Custom or out-of-stock designs: 21–35 working days from sample approval. Lead times are estimates and not guarantees. We will communicate delays proactively.

7. Payment terms

Standard terms: 50% advance on order confirmation, 50% balance before dispatch. For first-time buyers, full advance may be required. We accept bank transfer (NEFT/RTGS/IMPS), UPI, and (for established relationships) post-dated cheques. GST is charged at the prevailing rate (typically 12% for brass idols under HSN 8306).

8. Shipping and delivery

We ship PAN India via trusted courier partners. Shipping is billed at cost on the invoice. Risk of loss passes to the buyer upon dispatch; insurance is the buyer's responsibility unless explicitly included. See our Shipping Policy for details.

9. Returns, damages, and quality issues

Brass idols are inspected before dispatch. Damage in transit must be reported within 48 hours of delivery with photographs of the packaging and the damaged item. See our Returns Policy for resolution process. Manufacturing defects are replaced or credited at our discretion.

10. Intellectual property

All product designs, photographs, and website content are the intellectual property of Aagam Enterprise or its licensors. Reproduction without written permission is prohibited. Custom mold designs remain our property unless transferred by written agreement.

11. Limitation of liability

Our maximum liability for any order is limited to the invoice value of that order. We are not liable for indirect, consequential, or punitive damages. We are not responsible for delays caused by events beyond our reasonable control (force majeure: natural disasters, transport strikes, government action, pandemic).

12. Governing law and dispute resolution

These Terms are governed by the laws of India. Any dispute shall first be attempted to be resolved amicably; failing that, it shall be subject to the exclusive jurisdiction of courts in Muzaffarnagar, Uttar Pradesh, India.
